1. Agreement and who can use Auriginal

These Terms are an agreement between you and Auriginal, LLC ("Auriginal," "we") for the Auriginal iOS app, auriginal.app and verify.auriginal.app (the "Service"). By using the Service, you agree to them and to our Privacy Policy (auriginal.app/privacy).

You must be at least 13. If you're a minor where you live, a parent or guardian must agree for you.

Apple's standard Licensed Application End User License Agreement governs your license to the app. These Terms are additional terms for the Service and don't replace it.

There are no accounts or passwords. Your records are tied to a signing key created and kept on your iPhone, so keep your iPhone secure. The Service is free at version 1.0.

2. What a record means, and what it doesn't

Each photo or video you take with the app is sealed and signed on the iPhone that captured it. The app then sends the original file, the signed record and its sensor and check results to our servers. We keep the original private and show a copy, with its QR code, on the record page. A record shows that the file was sealed and signed on an iPhone running Auriginal, that at capture the original file matched the signed record, which of the iPhone's sensors took a reading at that moment, and which physics checks produced a consistent result. "Verify your copy" shows whether a file matches the sealed original.

A record does not show that what's depicted is true, accurate, complete, unstaged or lawful. Auriginal doesn't judge content, and a listed sensor took a reading; that isn't a check of the reading. Records and results are not legal, forensic, insurance or other professional advice. Don't rely on a record alone for any decision.

3. Your content

You own what you capture. You give Auriginal a worldwide, non-exclusive, royalty-free license to store, copy and process your captures and records as needed to run and protect the Service, and to display the record and the copy of your photo or video on its record page. We don't use your captures for advertising, sell them, or show them anywhere else. The license ends when you delete the record, except for copies our Privacy Policy describes, such as a note of the record ID and deletion date. Copies others already saved aren't affected.

Record pages can be opened by anyone with the record's link, QR code or a matching file. We ask search engines not to list them. You're responsible for your captures and any permissions they need, including from people in them.

4. Acceptable use: zero tolerance for objectionable content

We don't tolerate objectionable content or abusive users. You may not use the Service to capture, seal, share or upload:

• illegal content, or content that promotes illegal acts;
• any sexual content involving minors (we report it to NCMEC and law enforcement);
• harassment, threats, bullying or hate content;
• intimate or sexual images of anyone without their consent;
• content that infringes anyone's copyright, trademark or other rights;
• content that violates the privacy of people captured, such as filming them where they expect privacy.

You also may not forge, alter or transfer a seal or signature; reverse-engineer or bypass the app or its device checks; or overload, scrape or attack the Service.

We may remove any record and block the app installation that made it, at our discretion and without notice. To report a record, use Report this record on its page or email contact@auriginal.app. We review reports promptly and may remove content or restrict access where appropriate.

5. Copyright complaints

Send copyright notices to our designated agent: Copyright Agent, Auriginal LLC, 8401 Mayland Drive, Ste A, Richmond, VA 23294; phone 617-435-9607; email contact@auriginal.app (U.S. Copyright Office registration DMCA-1083391). Include your signature; the work infringed; the record link or ID; your contact details; a good-faith statement that the use isn't authorized; and a statement, under penalty of perjury, that the notice is accurate and you may act for the owner. Counter-notices go to the same agent. In appropriate circumstances we remove repeat infringers' records and block their app installations.

6. Changes, availability and termination

We may change, suspend or stop any part of the Service at any time, and don't promise the Service or any record will always be available or error-free. You may stop using it and delete your records in the app anytime. We may end your access if you break these Terms or to protect the Service or others. Sections 2, 3, 7 and 8 survive.

7. Disclaimers, limits of liability and indemnity

THE SERVICE AND ALL RECORDS AND CHECK RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT THE LAW ALLOWS, AURIGINAL WON'T BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, AND OUR TOTAL LIABILITY WON'T EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some places don't allow these limits, so they may not apply to you.

You'll indemnify Auriginal against claims and costs (including reasonable attorneys' fees) arising from your content or breach of these Terms.

8. Governing law, changes and contact

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Disputes go to the state or federal courts located in Virginia, and you and Auriginal consent to their jurisdiction.

We may update these Terms and will change the "Last updated" date; material changes will be noted in the app or on this page. Continued use means you accept them.
